Job Summary:

The Corporate Employment Counsel will support the Legal Department in providing practical, solutions-oriented advice on a wide range of employment law issues and partner closely with HR and internal stakeholders to help ensure legal compliance and mitigate risk.

Job Responsibilities:

  • Provide day-to-day legal advice and counseling on a broad range of employment issues, including hiring, compensation and benefits, wage and hour, government audits, HR practices, performance management, discipline, terminations, and others as requested.
  • Oversee employment litigation, including responding to subpoenas, handling EEOC charges and state-level equivalent charges, Department of Labor issues, government inquiries, and workers compensation claims.
  • Assist with responding to employee complaints and employment-related inquiries, and conduct and/or support internal and external investigations of complaints concerning violation of Company policies, laws and regulations
  • Monitor legal developments in federal, state, and local employment laws and help assess the impact on company policies and practices. Recommend specific company responses to changes in governmental and legislative policies.
  • Conduct legal research and help prepare clear, concise guidance and documentation, including legal memoranda and correspondence. Assist with drafting and updating internal employment policies and training materials.
  • Draft, review, and negotiate employment-related agreements such as offer letters, separation agreements, confidentiality agreements, arbitration agreements, non-competes, and non-solicitation clauses.
  • Advise HR and business leaders on compliance with leave-related laws (e.g., FMLA, state/local leave laws), and manage legal aspects of workplace accommodations under the Americans with Disabilities Act (ADA), including the interactive process and undue hardship evaluations.
  • Ensure compliance with the Fair Credit Reporting Act (FCRA) and other applicable laws in managing pre-adverse and adverse action procedures. Provide legal oversight of notices, disclosures, waiting periods, and work with other departments to make final determinations related to disqualification decisions.
  • Collaborate with internal teams on HR compliance initiatives and assist in policy audits and implementation efforts.
  • Participate in special projects and support senior legal team members on employment initiatives.

Job Qualifications:

Education and Certifications

  • Juris Doctorate from an accredited law school
  • Member of a state bar in good standing and eligible to register as in-house counsel in state of residence.

Work Experience

  • 5-7 years' experience and demonstrated competence as a practicing attorney in employment law.
  • Experience working with Employee Relations and HR as a partner and resource preferred.

Skills

  • Strong initiative and ability to manage multiple projects as well as strong follow through skills.
  • Demonstrated ability to understand and analyze complex legal matters, to concisely summarize significant legal concerns, and to communicate those concerns effectively to business people.
  • Direct experience with employment-related laws concerning but not limited to discrimination, harassment, compensation, benefits, accommodations/ leaves of absence, union/labor relations implications, the Fair Credit Reporting Act, and workplace safety.
  • Ability to work well with others in a fast paced, team-oriented and dynamic environment.

  • This job is performed in a temperature-controlled office environment.
